Terms of Service

These terms are an agreement between you and Casper Leary ("casperstatic", "we", "us") for your use of casperstatic.com (the "Service"). By creating an account or using the Service you agree to them. If you use the Service for a business, you agree on its behalf.

1. What casperstatic does

casperstatic reads a brand's public website, researches the brand and its competitors, writes static ad concepts with AI, and renders finished ad images through your own Higgsfield account. Features change over time and we may add, change or remove them.

2. Accounts

You need an account to use the Service. Keep your sign-in email secure: anyone with access to it can sign in as you. You're responsible for what happens under your account, including teammates you share a workspace with. You must be at least 18.

3. Credits and payment

• The Service runs on credits. One credit makes one ad. The number of credits a batch uses is shown before you start it.
• Credits are sold in packs through Stripe. Prices are shown before checkout and may change; a change never affects credits you already own.
• Credits don't expire, have no cash value, and can't be transferred or exchanged for money.
• If an ad in a batch fails to render, its credit is returned to your balance automatically.
• Purchases are final and non-refundable, except where the law requires otherwise or where we decide to issue a refund at our discretion. If something went wrong, email support@casperstatic.com.
• Free or promotional credits may be limited, changed or withdrawn at any time.

4. Higgsfield and other third parties

Images are rendered on the Higgsfield account you connect. Higgsfield charges those renders to your Higgsfield account under Higgsfield's own terms, separately from your casperstatic credits. We aren't responsible for Higgsfield's service, pricing or availability, or for any other third-party service the Service relies on.

5. Your content

"Your content" means what you give us (website addresses, uploaded ads and images, notes and feedback) and the ads the Service makes for you. As between you and us, you own your content. You give us a non-exclusive, worldwide license to store, process and use your content only to run, improve and support the Service for you. We don't sell your content.

You're responsible for having the rights to everything you upload and to the brands you make ads for. Only make ads for brands you own or are authorized to market.

6. Using the ads

Ads are written and rendered by AI and can contain mistakes: wrong or exaggerated claims, inaccurate product details, garbled text, or elements that resemble other ads or brands. Review every ad before you use it. You're solely responsible for the ads you publish, including making sure they're accurate, follow advertising law and platform rules (for example FTC rules and Meta's ad policies), and don't infringe anyone's rights.

The Clone and reference features recreate layouts and visual techniques from other ads. Use them for layout and style inspiration, never to copy another company's trademarks, copyrighted images, copy or trade dress.

7. Acceptable use

Don't use the Service to make ads that are illegal, deceptive, defamatory, hateful, sexually explicit, or that promote dangerous products; to impersonate a person or brand; to infringe intellectual property; or to make health, financial or other claims you can't substantiate. Don't try to break, overload, reverse engineer or get around limits on the Service, or access other people's accounts. We may remove content and suspend accounts that break these rules.

8. Our property

The Service itself, including its software, design, ad library and methods, belongs to us. These terms don't give you any right to it beyond using the Service as offered.

9. Ending your account

You can stop using the Service at any time and ask us to delete your account by emailing support@casperstatic.com. We may suspend or end your access if you break these terms, if required by law, or if we stop offering the Service. If we end the Service without cause, we'll refund unused purchased credits.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that ads will perform, be error-free, or that the Service will be uninterrupted.

11. Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

12. Indemnity

You'll defend and hold us harmless from claims arising from your content, the ads you publish, or your breach of these terms.

13. Governing law

These terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Missouri, and you and we consent to their jurisdiction.

14. Changes

We may update these terms. If a change is significant we'll let you know by email or in the Service. Continuing to use the Service after a change means you accept it.
